Title IX Team Probes Policies on Trans Students in Washington Superintendent’s Office

The Title IX Special Investigations Team, which collaborates with both the U.S. Department of Education and the Department of Justice, has initiated an inquiry into the Washington Office of the Superintendent of Public Instruction (OSPI). The team alleges that this office might be involved in potential misconduct. instructing school districts to disregard parental rights statutes and requiring that schools permit transgender students to join female athletic teams and utilize restrooms corresponding to their gender identity.

These reports suggest that OSPI’s policies might be at odds with several federal statutes such as Title IX, the Family Educational Rights and Privacy Act (FERPA), and the Protection of Pupil Rights Amendment (PPRA).

FERPA and PPRA are both federal privacy statutes. Under FERPA, parents have the authority to review their child’s educational records, seek modifications or corrections to these documents, as well as manage (subject to significant exemptions) who can see personal data contained within them. Meanwhile, PPRA ensures that parents receive notification and possess opt-out options whenever schools distribute assessments or forms containing specific delicate details regarding pupils and their households.

The team reports that several school districts in Washington State have expressed worries over OSPI requirements that permit boys to join girls' athletic teams and use gender-specific private spaces designated for females. These mandates could be seen as conflicting with Title IX regulations.

Moreover, an earlier letter from OSPI to the La Center School District pointed out concerns regarding policies that may bar parental notifications about alterations in their child’s gender identity, which could possibly violate FERPA and PPRA regulations.

The Office of Superintendent of Public Instruction (OSPI) reportedly warned the La Center School District about potential cuts in state funding due to the district's refusal to implement policies that could conflict with federal regulations. In February, for instance, OSPI instructed La Center not to disclose students' gender identities without obtaining the students' permission first. This directive might infringe upon parents' rights as granted by FERPA to review their children’s educational records.

OSPI allegedly instructed La Center to educate their staff on utilizing a screening instrument aimed at "removing bias concerning gender identity" from teaching resources, potentially breaching PPRA regulations that mandate educational institutions to involve parents when implementing guidelines that safeguard student privacy.

U.S. Secretary of Education Linda McMahon addressed the investigation, saying, "This inquiry into Washington OSPI marks an unprecedented effort, as it brings together ED and DOJ along with various departments within ED to address several possible breaches of federal law."

Washington State seems to leverage its authoritative stance to pressure school districts into withholding 'gender identity' details from students' parents and implementing policies that stealthily introduce gender ideologies into classrooms, causing confusion among students and allowing males access to females-only spaces such as sports teams, restrooms, and locker rooms," McMahon added. "Should this be accurate, these actions would clearly infringe upon parental rights and violate women's equality in sports, protections that are upheld under federal law and will be rigorously enforced by the Trump Administration.

The inquiry highlights the federal government’s dedication to upholding regulations designed to safeguard both parental rights and gender equity in sports. Breaches of Title IX, FERPA, and PPRA might result in the withdrawal of federal financial support from institutions of education.
